SmartinUpCreations respects the intellectual property rights of others and expects users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (the "DMCA"), we will respond promptly to claims of copyright infringement that are reported to our designated copyright agent.

Reporting Copyright Infringement

If you believe that content hosted on smartinupcreations.com infringes your copyright, please send a written notice to our designated agent containing the following information:

  • A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  • Identification of the copyrighted work you claim has been infringed, or if multiple works are covered by a single notification, a representative list of such works.
  • Identification of the material that you claim is infringing, with enough detail for us to locate it on the Site (a URL is ideal).
  • Your contact information, including name, address, phone number, and email address.
  • A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  • A statement, made under penalty of perjury, that the information in your notification is accurate and that you are the copyright owner or are authorized to act on their behalf.

Counter-Notification

If you believe that material was removed from the Site as a result of a mistake or misidentification, you may file a counter-notification with us. A valid counter-notification must include:

  • Your physical or electronic signature.
  • Identification of the material that was removed and its location before removal.
  • A statement under penalty of perjury that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification.
  • Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located.

Repeat Infringers

It is the policy of SmartinUpCreations to terminate access for users who are repeat copyright infringers in appropriate circumstances.

Good Faith

Please be aware that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing may be subject to liability. If you are unsure whether the material you are reporting infringes your copyright, consult an attorney before filing a DMCA notice.
